• The British Columbia Maritime Chamber (BCMEA) and the International Longshore Warehouse Union (ILWU) Local 514 Ship and Dock Foremen reached an interim agreement on October 2, 2019. The parties agreed that no details of the agreement will be published until the interim agreement has been ratified by both parties. The British Columbia Maritime Employers Association (BCMEA) and the International Longshore Workers Union (ILWU) Local 514 have been negotiating since the current collective agreement for Canada`s west coast expired in March 2018. Discussions are not going well and are broken. Note: This bargaining unit has a historic relationship with the Longshore men, who are covered by a separate agreement between the British Columbia Maritime Employers Association (BCMEA) and the International Longshore and Warehouse Union – Canada. A 4/3 ratio is maintained between the rates of pay for foremen of ships and ports and those of long-term workers covered by this agreement. For example, wage increases in the foremen agreement were deducted from the snack increases concluded in May 2011. In the first year of the agreement, employees receive a lump sum payment of $3.67 per total hour paid the previous year. The payment would be approximately $7,350 for full-time employment. The last Foremen contract expired on 31 March 2019 and negotiations resumed shortly after the ratification of the long-hore collective agreement at the end of June.

    A 96-month renewal contract, which came into effect from April 1, 2010 to March 31, 2018, was concluded in January 2012 during the conciliation phase. Negotiation duration – 26 months. UPDATE: Status of negotiations with ILWU Canada Longshore and ILWU Ship and Dock Foremen Local 514. After five (5) days of successive meetings over the past week and despite all efforts, key issues have not been resolved between the parties. However, the parties have agreed to file a joint complaint with the Minister of Labour, who will now appoint a conciliation mediator for the ongoing discussion on contract renewal. This notification was filed on Friday, January 25, 2019. Note: The Minister has a maximum of 15 days to appoint a conciliation mediator. In May 1994, Longshore`s collective agreement was signed with BCMEA, but the foremen were still negotiating their contract. One of the new provisions of the 1994 treaty was a half-hour day shift meal.

    While Longshore was obliged to comply with this provision of the new contract, the foremen were still in the terms of their old agreement and took an hour for lunch. Percentage based on the increase in the Vancouver All Items ICC (1992-100) over the last three calendar years of the agreement, exceeding 2.9% in 2016, 3.2% in 2017 and 3.6% in 2018. Any correction must be paid in the form of a one-time lump sum payment based on the hours worked in the calendar year. The filing of this joint dispute settlement triggered the following deadline under the Canadian Labour Code: the application of the aforementioned time line to a calendar means that the 21st day after the conciliation ends will be Wednesday, May 1, 2019. During the 21-day period, each party may strike 72 hours or lock out, provided that it meets the conditions of a vote and has received a mandate from the majority that voted. We remain cautiously optimistic that the parties will reach a renewal agreement with the support of the Federal Mediation and Conciliation Services (CSMF). Negotiation dates are scheduled for early February to meet with ILWU Ship and Dock Foremen Local 51. On January 25, the two parties filed joint dispute resolution letters – the British Columbia Maritime Employers Association (BCMEA) and the International Longshore Workers Union (ILWU), at which time discussions were virtually interrupted.
